Supreme Court declares unconstitutional Act 100 and determines output benefited
The more than 96 000 State servants who have benefited from the realization of their offices after sanction of the State Complementary Law 100 should leave office immediately. This understanding was unanimously of the Federal Supreme Court (STF), which considered the afternoon of Wednesday (26), the Direct Action of Unconstitutionality (ADI) proposed by the Attorney General's Office.
The determination has some caveats, but the decision will cause a big impact for the state of Minas Gerais. The Court ordered the departure of all servers from the publication of the judgment. According to a spokesperson of the Supreme Court, published by the State of Minas Gerais, there is a given for the publication of the sentence term, therefore, is not yet possible to predict the output of the servers.
The minister Dias Toffoli declared that those who benefited from the retirement or to which this situation until the date of publication of the sentence will not be achieved.
