A school day is scheduled for one class, no matter the number of students present. While there is a small number of students, or just in the classroom, the teacher should give the expected content and take missing persons absent. "This class has the right to scheduled activity," says Mary Eveline, general coordinator of the Secondary Education Department of Basic Education, Ministry of Education and Culture (MEC).
Law of Guidelines and Bases (LDB), which regulates education in Brazil, schools must serve at least 200 school days per year, divided into two semesters. Totaling at least 800 hours, or 48,000 minutes (800 hours x 60 minutes). Schools that consider this account the time-class, which is usually 45 minutes, violate the law. Parents therefore need to be vigilant to ensure the rights of children.

If for some reason there is no school, the school needs to replace the suspended period at least until the 200-day minimum established by law. "In emergency cases, the requirement of 200 days may be canceled if the State Education Department so determines," said Luiz Gonzaga Pinto, president of the Association of Education Specialists of the Official Teaching of the State of São Paulo.
Luiz explains that this can happen because the LDB provides adaptations of the school year in accordance with local or even climatic peculiarities. Ie, in case of natural disasters or infectious diseases such as influenza A (known as swine flu), the 200 days can not be met.
Because of this flexibility in the law, the State Board of Education of São Paulo issued a decree in the Official Gazette on August 8, from public and private schools, the decision to replace or not classes postponed because of the swine flu epidemic . The important thing, according to Maria Eveline, is that the school take care of all the contents programmed teaching students in these 200 days. "The institution must meet its planning. Parents and students, as well as the entities that represent them, have the right to monitor and to be informed of how the school will make the replacements."
